Terms and Conditions of Sale

Last updated: 29 July 2026

Article 1 – Seller’s identity and scope

These Terms and Conditions of Sale, hereinafter referred to as the “Terms”, govern sales of products made on the website www.theenglishshop.fr between S & D CLESINGER, a French limited liability company (SARL) with a share capital of €105,040, registered with the Rouen Trade and Companies Register under SIRET number 481 119 006 00023, whose registered office is located at 103 rue Ganterie, 76000 Rouen, France, and any consumer or non-professional customer making a purchase on the website.

The applicable Terms are those presented to and accepted by the customer on the date of the order. They can be accessed, downloaded and printed before the contract is concluded.

Article 2 – Products

The English Shop sells, among other products, teas and accessories. The essential characteristics, ingredients or materials, including any allergens, quantity and price are provided on the product page before the order is placed.

Photographs and illustrations are provided for information purposes. They do not reduce the seller’s obligation to deliver a product that conforms to the essential characteristics advertised.

Product offers and prices remain valid for as long as they are displayed on the website.

Article 3 – Prices

Prices are stated in euros, inclusive of all applicable taxes for the sales concerned, and excluding delivery charges. Delivery charges and the total amount payable are displayed before the order is finally confirmed.

S & D CLESINGER may change its prices at any time, without retroactive effect. The price charged is the price displayed when the order is confirmed, subject to any obvious pricing error that the customer could not reasonably have failed to notice.

Article 4 – Orders and formation of the contract

The customer selects the products, checks their basket, provides the necessary information and chooses the delivery and payment options. They may correct any errors before finally confirming the order.

Before making payment, the customer must read these Terms and accept them by ticking a checkbox that is not preselected. The final button displays the wording “Order with obligation to pay” or an equivalent unambiguous statement.

The order is confirmed once payment has been accepted. An order summary email is sent to the customer on a durable medium. The seller may refuse an order on legitimate grounds, including suspected fraud, an obvious error, unavailability or a previous payment dispute, without engaging in unfair discrimination.

Article 5 – Payment

Payment is due in full when the order is placed and must be made in euros using one of the payment methods offered at checkout. Card payments are processed by Stripe in a secure environment.

S & D CLESINGER does not retain the full payment card number. The order is prepared only after payment has been confirmed. If payment is declined, the customer is invited to use another payment method or contact their bank.

Article 6 – Delivery

Delivery is available within mainland France and to the European Union countries listed in the Delivery Information . Delivery methods, zones, rates and estimated delivery times are presented before the order is placed and set out in that document.

Orders placed Monday to Friday are generally processed within 24 to 48 hours. Orders placed over the weekend are processed from the following Tuesday, subject to public holidays and announced closures.

Delivery times are estimates, and S & D CLESINGER cannot under any circumstances be held responsible for the carrier’s delivery times.

Delivery is made to the address or pickup point selected by the customer. The customer must provide all information essential for delivery, including the correct address, door access code, etc. S & D CLESINGER cannot be held liable if a delivery is returned due to an incorrect address or an inability to deliver to the address provided.

The seller remains responsible for the proper performance of delivery until the parcel is physically handed over to the customer or a third party designated by them.

If the parcel is not received, the customer may submit a claim within a maximum of 30 days from the date the order was confirmed.

In this case, once the processing time required to locate the parcel has elapsed, an identical order will be dispatched again at no additional cost to the customer.

The customer is invited to check the condition of the parcel upon delivery and promptly report any issues, including photographs where possible. This helps with claims against the carrier but does not deprive the consumer of their statutory guarantee rights.

All products purchased from S & D CLESINGER are delivered to the customer by a transport company. Any risk of loss of or damage to the products passes to the customer when they, or a third party designated by them other than the carrier, take physical possession of the products.

Article 7 – Transfer of ownership and risk

The seller retains ownership of the products until the price has been paid in full. The risk of loss or damage passes to the customer when the customer or a third party designated by them takes physical possession of the product, subject to applicable mandatory rules.

Article 8 – Right of withdrawal

The consumer has fourteen days from receipt of the goods by themselves or a designated third party to notify their decision to withdraw, without having to give a reason.

The right of withdrawal may be exercised using the online “Withdraw from the contract” function, the model form below, or any unambiguous statement sent to contact@theenglishshop.fr or to S & D CLESINGER, 103 rue Ganterie, 76000 Rouen, France.

After giving notice, the customer must return the products within fourteen days at the latest. The customer bears the direct cost of returning the products, unless the seller has made an error or stated otherwise before the order was placed.

The products concerned must be in their original condition and packaging and must not have been opened, unpacked, damaged or used. Otherwise, they will not be eligible for a refund.

The refund, including the original delivery charges, will be made using the payment method used for the order within 14 days of receipt of the returned products. Return costs remain the customer’s responsibility.

No provision of these Terms limits the consumer’s mandatory rights, statutory guarantees, liability for defective products, or liability for gross negligence, wilful misconduct or personal injury.

Article 15 – Governing law and dispute resolution

These Terms are governed by French law, without depriving consumers residing in another European Union Member State of the mandatory protections afforded by their country of residence.

If no amicable settlement or resolution through mediation is reached, the dispute may be brought before the competent court in accordance with the procedural rules applicable to the consumer.

The consumer is not required to submit disputes exclusively to the courts of Rouen.

Article 16 – Severability and evidence

If any provision is declared void or unenforceable, the remaining provisions shall remain applicable.
